Terms of Service
Kui Spa (hereinafter referred to as “this salon”) has established the following terms of service to ensure that you use our mobile massage/beauty/relaxation services (hereinafter referred to as “this service”) appropriately.
1. Scope of application of these terms
These terms apply to our salon and users of this service (hereinafter referred to as “customers”).
2. This service
This service refers to a therapist from our salon (hereinafter referred to as “Therapist”) visiting the accommodation facility specified by the customer and providing massage/beauty/relaxation services. This service does not constitute medical treatment, and is not a medical procedure performed by a nationally certified therapist. In addition, our salon does not guarantee that this service will have any effect on the customer’s health, etc.
3. Conditions for Use of This Service
- This service is for women only. We do not accept men.
- When using this service, customers shall comply with these terms and conditions and other terms and conditions and precautions set forth by our salon.
- In order for customers to receive this service, they shall make a booking on the website operated by our salon.
- When making a booking on the website, customers shall enter personal information such as their name and phone number, and then enter their credit card information to make a web payment.
- There are limitations to the services that can be provided by this service, and customers agree not to request services beyond the limitations or a reduction in fees.
4. Establishment of the Service Agreement
A booking for this service is considered complete when a message appears on your browser indicating that the booking has been completed, or when the salon contacts you by phone to confirm the booking, or when it sends you an email notifying you of the confirmed booking details, and at that point a service contract is formed between the salon and you.
5. Cancellation of Booking
Notwithstanding the provisions of the preceding article, if the salon determines that the customer has violated these terms or other terms stipulated by the salon, or if the customer is found to have engaged in any of the prohibited acts set forth in Article 6, the salon reserves the right to cancel the customer’s reservation without prior notice, to not provide the service, or to refuse to travel to the designated location.Furthermore, even if the violation is discovered during the provision of the Service, the treatment will be suspended, the customer will leave, and the service will be refused, and if necessary, the police will be notified. In this case, the Company will not refund any of the service fees, and may claim damages from the customer.
6. Prohibited acts
- Registering false information when making a booking
- Making a false or unreasonable application when making a booking
- Making a booking on behalf of another person without that person’s consent
- Booking made by organized crime groups, members of organized crime groups, organizations or associates related to organized crime groups, or other antisocial forces
- Any action that unduly interferes with the operation of this service or causes disadvantage to our salon, or that may have the potential to do so
- Any action that infringes the rights of other customers or third parties, or that may cause disadvantage to them
- Any action that uses this service for commercial purposes
- Acts of requesting this service in an unsanitary environment, in unsanitary clothing, or with an unsanitary body
- Acts of requesting this service while in a state where there is a risk of infection of the therapist with an infectious disease, skin disease, sexually transmitted disease, etc.
- Acts that violate public order and morals and laws and regulations, or acts that may do so
- Acts of requesting this service while in a drunken state or using marijuana, paint thinner, drugs, etc.
- Acts of requesting sexual services
- Acts that make the therapist feel uncomfortable, such as contact, violence, or solicitation (behavior or behavior)
- Acts that the company deems inappropriate, in addition to the above items
7. Cancellation and Change of Booking
- When a customer wishes to cancel or change a reservation, they must contact the salon using the method specified by the salon, and the reservation will be canceled or changed when the salon accepts the request.
- If a customer requests to cancel a reservation at a time when a cancellation fee specified by the salon would be incurred, such as just before or on the day of the reservation, the customer must pay the cancellation fee specified by the salon.
- The cancellation fee will be paid online by the salon using the credit card registered when making the online reservation.
8. Personal Information
We will not disclose to third parties any personal information that we learn about when making booking for this service or providing this service, except in the following cases.
- When disclosure is requested by a public institution with legitimate authority
- When the user himself/herself agrees
- When an emergency situation occurs that requires a response
Our salon may use your registration information for the purpose of investigating usage trends of this service, but in such cases, we will not disclose your personal information or usage history to third parties in a manner that can identify you.
In addition to the above, our salon will handle your personal information appropriately in accordance with our “Privacy Policy“.
9. Disclaimer
If the customer causes any disadvantage or damage to a third party by using this service, the customer and the third party shall resolve the matter at their own responsibility, and the salon shall not be held responsible in any way.
Even if the customer suffers any disadvantage or damage as a result of being unable to use this service due to any of the reasons set out in each item of Article 6, the salon shall not be held responsible for any compensation.
10. Changes to these Terms
The Salon may change these Terms without prior notice to the customer as necessary. If the customer uses the Service after the Terms have been changed, the Salon will assume that the customer has accepted the changed Terms.
11. Discussion
If any problem arises regarding the use of the Service regarding matters not specified in these Terms, the customer and the Salon shall discuss the matter in good faith and attempt to resolve it.
12. Agreement Jurisdiction
If a dispute arises regarding the use of this service that cannot be resolved through discussion between you and our salon, the first instance of the exclusive jurisdiction of the district court or summary court with jurisdiction over our company’s location shall be resolved in accordance with the laws of Japan.
